Terms and conditions of Lunna and their application
The service channel of the digital services of the Western Uusimaa Wellbeing Services County is called Lunna (“the Service”).
To use the digital services of the Western Uusimaa Wellbeing Services County, the user is required to accept these terms and conditions, commit to complying with them, and give their consent to digital services when enabling the Service. The terms and conditions describe the use of the Service, the processing of the data created when the Services is used, and the responsibilities of the Service provider and the user of the Service. When registering for the Service, the user must familiarise themselves carefully with the terms and conditions and accept them in their entirety. The user must also familiarise themselves with the description of the processing of personal data, which is presented in the privacy policy.
By accepting these terms and conditions and by registering for the Service, the user declares that they have understood what they have read and commits themselves to complying with the terms and conditions of the Service.
Only a registered user of the Service has the right to use their user account in the Service. The Service may also be used on behalf of the user by a person who in accordance with these terms and conditions has the right to register for and use the Service on behalf of the user.
The user or the person using the Service on behalf of the user shall always be solely responsible for the use of the Service in accordance with these terms and conditions. The user must immediately inform the Western Uusimaa Wellbeing Services County if they suspect that the Service is used on their behalf against their authorisation or in violation of these terms and conditions.
The only right received by the user in accordance with the terms and conditions of the Service is the right to use the Service.
When accepting the terms and conditions of the Service and when using the Service, the user confirms that they understand the following principles:
- I understand that if my matter requires immediate help, I will ring the emergency number 112.
- I understand that I am myself responsible for ensuring that the information I have provided in the Service is correct.
- I understand that the information I forward through the Lunna application may end up being part of my patient information in healthcare and/or my client information in social welfare. In this case, the statutes and regulations concerning client and patient information will apply to it.
- I understand that not all of the information that I forward through the Lunna application is saved as patient information in the patient information system but is saved on the service platform provided by the supplier. For example, this information may include the content of the discussions held and the answers given to surveys. Essential information affecting decisions on care and services are recorded as client and patient information in the client and patient information system.
- I understand that the Western Uusimaa Wellbeing Services County may send me digital messages, notifications and decisions that I am entitled to be informed about via the Service. Western Uusimaa Wellbeing Services County will request separate consent for electronic notice of decisions.
- I understand that I may be denied the right to use to the Service if I intentionally misuse it. For example, misuse includes threatening and appropriate behaviour, unnecessary contact requests and sending offensive or illegal material.
- I understand that the Lunna application may sometimes be unavailable, for example, because of maintenance breaks, technical faults or other similar reasons.
- I understand that information created without identification will not be saved in the Service and no entries related to it will be made in the patient or client information systems.
- I understand that I must have functioning connections and sufficient technical capacities and software for using the Service.
- I understand that I am also responsible for the security and functioning of the devices and software I use.
- I understand that I have the obligation to keep my credentials secret and that I am responsible for all use of the Service carried out with my credentials and any fees, obligations and consequences that may be caused by it.
The Western Uusimaa Wellbeing Services County is not in any way responsible for any direct or indirect harm or costs caused to the user or third parties by the Service or its malfunctions.
Consent for the use of digital services in healthcare and social welfare
By accepting the terms and conditions, the user of the Service consents to digital use of services with a healthcare and social professional and to the digital messages, notifications and decisions sent by the Western Uusimaa Wellbeing Services County that the user is entitled to be informed about. The user of the Service understands that the use of the Service is voluntary and the user can withdraw their consent at any time. Consent can be withdrawn by deleting the account in the Lunna application.
Based on their consent to electronic use of services, the user has the obligation to use the Service in accordance with these terms and conditions, the EU General Data Protection Regulation, national legislation, official specifications and good practice. The user is fully responsible for all use of the Service in violation of the consent for the digital use of services, the terms and conditions of the Service, law, the official regulations or good practice.
Administrators of the Service
The Service is provided by the Western Uusimaa Wellbeing Services County, www.luvn.fi . The technical implementation of the application is the responsibility of BeeHealthy Oy, https://www.mehilainen.fi/en/beehealthy(external link)(external link) .
The maintenance of the contents of the Service and the healthcare and social welfare services provided through it are the responsibility of the Western Uusimaa Wellbeing Services County (switchboard +358 29 151 2000, email info@luvn.fi ).
About the application
The Service is not intended for service use related to life- or health-threatening emergencies. If the user’s matter requires immediate help, the user must call the emergency number 112.
The Service enables you to contact a healthcare and social welfare professional fast and securely. It makes the use of a chat service, video appointments, non-urgent and real-time exchange of messages, and responding to forms and surveys possible. However, it is not possible to guarantee that the messages sent through the Service will be read immediately in all situations. The service may be used only in accordance with its intended purpose.
You can use the Service with the web-application at lunna.suomisote.fi(external link)(external link) or download a mobile application from the app store on an IOS or Android smartphone. You must register as a user of the service when you first use it. Identification for the Service takes place in the Suomi.fi service and you will need your online banking codes, mobile certificate or a certificate card for identifying yourself. Certain services in Lunna can be used without registration, as an anonymous user. The user can also identify themselves after first having started service use without identification.
You can also use the Service on behalf of another person if the authorisation has been made through Suomi.fi e-Authorizations. The right to act on behalf of another person is always checked through Suomi.fi e-Authorizations when you log into the Service.
Some of the data used in the Service is collected through the Suomi.fi service. These include first name and surname, personal identity code and address details. The telephone number and email address must be updated in the Service by the user.
Registering for the Service and using the Service are free of charge for the user. However, services subject to client fees in accordance with the valid client fees of Western Uusimaa Wellbeing Services County may be offered to the user in the Service. The user will be informed clearly that there will be a charge for the service (for example, a doctor’s appointment) before the service is booked or before the user is referred to it, and it is always possible for the user to refuse a service that is subject to a charge. Efforts have been made to ensure the correctness, accuracy, reliability and usability of the information presented in the Service carefully before publishing it, and the correctness and functionality of the information contained in the Service is checked regularly.
The functionalities and services of the Service develop constantly. The Western Uusimaa Wellbeing Services County has the right to change the instructions, the range of services provided, the service hours, the appearance of the Service or other features of the Service without prior notice. The Western Uusimaa Wellbeing Services County will make efforts to notify any material changes in connection with the Service.
The Western Uusimaa Wellbeing Services County does not guarantee uninterrupted and error-free operation of the Service. The Western Uusimaa Wellbeing Services County has the right to interrupt the operation of the Service because of a change, reform, maintenance or installation work in the Service or other similar reasons related to the Service, or if required by legislation or some other official regulation. Efforts are made to notify users of downtimes as early as possible by publishing a general notice on the home page of the Service.
Terminating the use of the Service and deleting the account
The use of the Service is voluntary and the user may terminate it at any time. The user may delete the account created for using the services on the lunna.suomisote.fi website or in the mobile application, or by submitting a written notice to the Western Uusimaa Wellbeing Services County, kirjaamo@luvn.fi. Information security
The user of the Service is aware that the public information network and online services are not fully secure. The user is responsible for taking care of the appropriate information security of the devices they use and the software used on these devices. The Western Uusimaa Wellbeing Services County and BeeHealthy Oy organise the information security of the Service in a generally accepted and efficient manner and aim to prevent unauthorised access to their information systems with appropriate solutions. The credential-based data sent through the Service are always transferred by using a data transfer method with the strongest possible encryption.
Use of cookies
The Service uses necessary cookies that help the developers of the Service obtain valuable information to support the development. Mandatory cookies ensure that the Service functions correctly.
Copyright
The content and appearance of the Service are protected by copyright. All copyrights and other immaterial rights related to the Service belong to the Western Uusimaa Wellbeing Services County, BeeHealthy Oy, collaborative partners and/or other third parties.
Copying, printing, disseminating, amending and any other kind of commercial use of the Service or the material in the Service without separate written permission of the copyright holder is prohibited. However, the user of the Service may print and save material from the Service for their own private use.
Processing of personal data
The data controller of the Service is the Western Uusimaa Wellbeing Services County.
When processing users’ personal data, the Western Uusimaa Wellbeing Services County complies with the valid data protection legislation, such as the EU General Data Protection Regulation (GDPR 2016/678) and the Data Protection Act (1050/2018) and the good data processing practice.
The implementation of the data subject’s rights and the processing of personal data in the Service has been described in the privacy policy of the digital services of the Western Uusimaa Wellbeing Services County.
As for the data saved in the patient register, the implementation of the data subject's rights and the processing of personal data have been described in the Privacy policy of the Patient Register of the Western Uusimaa Wellbeing Services County.
What information will be retained after the account is deleted?
After the account has been deleted, the data related to the use of the digital chat of the Service and the patient information recorded in the patient information system in connection with service use will be stored in accordance with the Annex on retention periods in the Act on the Processing of Client Data in Healthcare and Social Welfare (703/2023).
Data and data retention period
- Personal data (in connection with creating the account): not retained.
- Digital chat transaction information: retained for three (3) years from the date.
- Notifications: not retained.
Resolution of disputes
Finnish law applies to the terms and conditions of the Service and to issues related to it. Efforts will be made to resolve any issues related to the Service or its terms and conditions primarily through negotiations between the Western Uusimaa Wellbeing Services County and the user. Any disputes shall be dealt with in the Western Uusimaa District Court.
Amendments
If necessary, the Western Uusimaa Wellbeing Services County has the right to unilaterally amend the terms and conditions by informing the user of this through the Service. The amendment of the terms and conditions shall enter into force as from the date notified by the Western Uusimaa Wellbeing Services County. To continue using the Service, the user must accept the updated terms and conditions. If the user does not accept the updated terms and conditions, they cannot continue to use the Service.
Validity
The terms and conditions of the Service are valid until further notice.
